DIREITOS HUMANOS COMO CONCEITO EM MOVIMENTO?

Artigo sobre a definição de direitos humanos como conceito em movimento. Mediante revisão bibliográfica, como objetivos buscou-se examinar se o direito natural pode ser considerado como fundamento de validade dos direitos humanos; em seguida, pretende-se analisá-los no contexto positivista do direito internacional; por fim, verificar se a concepção atual dos direitos humanos contribui para a construção do seu conceito, reconhecendo o papel dos precedentes nesta empreitada. Como hipótese, os direitos humanos apresentam-se como conceito em movimento. Como resultado, verificou-se que ainda que os direitos humanos, no contexto do direito internacional, estejam em “constante movimento”, parte do seu conteúdo pode ser considerado “estático”, prevalecendo a manutenção de um núcleo “duro e essencial”, responsável pela definição de sua identidade - como instituto jurídico responsável pela proteção da pessoa humana.
